1. Definitions

"The Art of Beauty," "we," "us," or "our" refers to the aesthetic medical practice operated by Dr Thys Heyns (HPCSA: MP0428302). "You" or "your" refers to the user of this website or recipient of our services. "Services" refers to all aesthetic treatments, consultations, and related services provided by our practice.

2. Use of Website

This website is provided for informational purposes only. You may use this website for lawful purposes and in accordance with these Terms. You agree not to use the website in any way that violates any applicable South African law or regulation, or to engage in any conduct that restricts or inhibits anyone's use of the website.

3. Appointments and Consultations

All treatments require a prior consultation. Appointments can be made via WhatsApp, telephone, or email. We require at least 24 hours' notice for cancellations or rescheduling. Failure to provide adequate notice may result in a cancellation fee.

We reserve the right to refuse or cancel appointments at our discretion, including but not limited to situations where we believe treatment may not be appropriate for the patient.

4. Informed Consent

Prior to any treatment, you will be required to provide written informed consent. This consent acknowledges that you have been informed of the nature of the treatment, expected outcomes, potential risks and complications, alternative treatments, and post-treatment care requirements. Treatment will not proceed without valid informed consent.

5. Payment Terms

Payment is required at the time of service unless otherwise agreed in writing. We accept cash, credit/debit cards, and EFT payments. Prices are quoted in South African Rand (ZAR) and are subject to change without notice.

Aesthetic treatments are generally not covered by medical aid. It is your responsibility to confirm coverage with your medical aid provider if applicable.

6. Refund Policy

Due to the nature of aesthetic medical treatments, refunds are generally not provided once treatment has commenced. If you are dissatisfied with your treatment results, please contact us to discuss your concerns. We are committed to patient satisfaction and will work with you to address any issues within medically appropriate parameters.

7. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of The Art of Beauty or its content suppliers and is protected by South African and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

8. Patient Confidentiality

We are committed to maintaining the confidentiality of your personal and medical information in accordance with the Protection of Personal Information Act (POPIA) and the National Health Act. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your information.

9. Photography and Testimonials

With your written consent, we may take photographs of your treatment results for medical records and, where separately consented to, for educational or marketing purposes. You have the right to withdraw consent for marketing use at any time. Any testimonials displayed on our website have been provided with the patient's express consent.

10. Limitation of Liability

To the maximum extent permitted by South African law, The Art of Beauty and Dr Thys Heyns shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or our services. Our liability for any claim arising from treatment shall be limited to the fee paid for that specific treatment.

11. Complaints Procedure

If you have any complaints about our services, please contact us directly so we can address your concerns. If you are not satisfied with our response, you may lodge a complaint with the Health Professions Council of South Africa (HPCSA).

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

13. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to this website. Your continued use of the website or our services following any changes constitutes acceptance of the revised Terms.
